By downloading, installing, and using the Sealr mobile application (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

3. Service Description

Sealr is a mobile-based commodity trading platform that provides:

The Service is for informational and trading purposes only. We are not a licensed investment advisor, and nothing in this Service constitutes investment advice.

4. User Eligibility

To use Sealr, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction)
  • Have legal capacity to enter into a binding contract
  • Not be a resident of jurisdictions where commodity trading is prohibited
  • Provide accurate and truthful information

You are responsible for ensuring that your use of Sealr complies with all applicable laws in your jurisdiction.

5. User Account and Security

When you create a Sealr account:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You agree not to share your account with others
  • You are liable for all activity conducted through your account
  • You must enable two-factor authentication (2FA) for account security
  • You will notify us immediately of any unauthorized access

6. Trading and Risk Disclosure

IMPORTANT RISK DISCLOSURE: Commodity trading is highly risky and can result in substantial losses of capital. You should only invest capital you can afford to lose. Never trade commodities with borrowed money unless you fully understand the risks.

By using Sealr, you acknowledge and accept these risks:

  • Volatility Risk: Commodity prices are highly volatile and can move rapidly
  • Leverage Risk: Trading with leverage amplifies both gains and losses
  • Liquidity Risk: During market stress, positions may not be liquidated at desired prices
  • Market Risk: Geopolitical events, weather, and economic factors impact commodities
  • Operational Risk: Technology failures or internet issues may prevent trading

7. Prohibited Activities

You agree not to:

  • Engage in market manipulation, spoofing, or layering
  • Use the Service for illegal activities or money laundering
  • Attempt to hack, reverse-engineer, or disrupt the Service
  • Use automated bots or scripts (unless explicitly authorized)
  • Impersonate other users or provide false identity information
  • Engage in insider trading or use non-public information
  • Violate sanctions or trade with restricted entities

8. Intellectual Property

All content in Sealr (logos, designs, code, trademarks, market data) is the property of Sealr or licensed content providers. You may not:

  • Copy, modify, or redistribute the Service without permission
  • Use the Sealr trademark or branding for commercial purposes
  • Reverse-engineer or attempt to extract algorithms or strategies

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

Sealr and its operators (including Jordy Robert Thomas) are not liable for:

  • Trading losses, regardless of cause
  • Data loss, corruption, or system failures
  • Delayed or missed orders due to technical issues
  • Inaccurate market data or pricing delays
  • Indirect, incidental, or consequential damages

Except: We remain liable for our gross negligence, willful misconduct, and violations of mandatory consumer protection laws.

10. Disclaimer of Warranties

Sealr is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not warrant:

  • Uninterrupted or error-free service
  • Accuracy or completeness of market data
  • Fitness for a particular trading purpose

11. Termination

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You provide false identity information
  • We cease operating the Service in your jurisdiction

Upon termination, you must cease all use of Sealr. We will settle your open positions and return your funds according to applicable law.

12. Changes to Terms

We may modify these Terms at any time. Continued use of Sealr after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands and the European Union, without regard to conflict-of-law principles. You agree to submit to the jurisdiction of the Dutch courts for any disputes.

14. Dispute Resolution

Before pursuing legal action, you agree to attempt good-faith resolution by contacting us at support@getsealr.com. If unresolved, disputes will be resolved through Dutch courts or mediation as applicable.

15. Compliance with Regulations

You agree to comply with all applicable laws, regulations, and exchange rules, including but not limited to:

  • Dutch Financial Markets Authority (AFM) regulations
  • European Securities and Markets Authority (ESMA) guidelines
  • GDPR (General Data Protection Regulation)
  • Anti-Money Laundering (AML) and Know Your Customer (KYC) requirements
